Article 1: General Provisions
The general terms and conditions of sale and the special conditions form a whole that is an integral part of the sales contract, the global acceptance of which is mandatory before the conclusion of any sale.
The reservation request implies adherence to these terms and conditions of sale and the complete and unreserved acceptance of their provisions.
Terms used herein with a capital letter without having been previously defined have the meaning given to them below:
“Hotel” refers to the Casa Cosy hotel.
“Hotel Website” refers to the website dedicated to the Hotel accessible at the following address: https://hotel.casacosy.fr.
These general terms and conditions of sale apply notably to sales operations concluded by Hotel Casa Cosy with individual or professional clients and to services provided by the establishment within the framework of an accommodation contract concluded with the client, the contract and the GTC forming an inseparable whole. In the event of a contradiction between the provisions of the GTC and those of the contract, the provisions of the contract alone shall apply.
These general terms and conditions of sale apply to all reservations concluded via the internet, through our booking platform, by telephone, or by mail (email or postal).
The client is the company signing the accommodation contract. The beneficiary is the natural person who benefits from the services reserved under the accommodation contract.
They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties. The client acknowledges having read and accepted these general terms and conditions of sale and the sales conditions of the reserved rate accessible on our booking platform.
These general terms and conditions of sale are available for consultation by the client on the hotel’s website to allow them to make their reservation. Any reservation therefore implies the client’s full and unreserved adherence to these conditions to the exclusion of any other document such as brochures, commercial documents, etc.
Article 2: Capacity
The client acknowledges having the capacity to contract, i.e., being of legal age and not being under guardianship or trusteeship.
Article 3: Reservation
1. Prices related to the reservation of services are indicated before and during the reservation process.
2. Indicated prices are per room for the number of person(s) and selected date(s).
3. Prices are confirmed to the client as an amount including all taxes (TTC), in the hotel’s commercial currency, and are only valid for the duration indicated on the site.
4. All reservations, regardless of their origin, are payable in Euros.
5. Unless otherwise stated, additional services (breakfast, etc.) are not included in the price.
6. Prices take into account the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the prices indicated on the invoice date.
7. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the invoice date.
8. Rates may be increased by various taxes depending on the city/country. The Client agrees to pay the various taxes without any dispute with Hotel Casa Cosy.
9. A reservation is validated after verification of the credit card provided. A pre-authorization file for the amount of the 1st night will be opened and closed after the client’s departure.
Article 4: Cancellation Conditions
1. The client is reminded, in accordance with the French Consumer Code, that they do not have the right of withdrawal provided for in Article L. 121-20 of the Consumer Code.
2. The sales conditions of the reserved rate specify the terms for cancellation and/or modification of the reservation.
3. Reservations with prepayment cannot be subject to any modification and/or cancellation. The sums paid in advance, which are deposits (arrhes), will not be subject to any refund.
4. When the sales conditions of the reserved rate allow it: the cancellation or modification of the reservation can be made directly with the hotel, whose email address and telephone number are specified on hotel.casacosy.fr
5. In the case of a modifiable or cancelable offer, the client must notify the hotel 72 hours before their arrival (fixed at the 3:00 PM check-in time). In the event of a modification or cancellation request that does not respect this deadline, the hotel will charge the client, as a flat-rate compensation, the amount of the first two nights on the credit card provided as a reservation guarantee.
6. In the event of an interrupted stay (unforeseen departure), the client must pay for the entirety of their reservation.
7. Unless expressly provided otherwise, rooms are made available from 3:00 PM (Check-in) on the day of arrival, and the client must vacate the room by 11:30 AM (Check-out) on the day the reservation ends. Failure to do so will result in the billing of an additional night.
8. In the event of a reservation cancellation by the Hotel, the client will be refunded double the deposit (arrhes) they paid, as compensation.
Article 5: Payment Terms
Payment for all services will be made directly to the hotel (except for reservations prepaid at the time of booking).
1. The client provides their bank details as a guarantee for the reservation, except for special conditions or rates, via credit or private bank card (Visa, Mastercard, American Express) by directly entering the card number, without spaces between digits, as well as its validity date and the visual cryptogram (CVV) in the area provided for this purpose (secured entry via SSL encryption).
2. The payment is debited at the hotel during the stay, except in the case of special conditions or rates where the payment is debited at the time of reservation (online prepayment for certain rates). This prepayment is qualified as a deposit (arrhes).
3. In the case of a rate subject to online prepayment, the sum paid in advance (the deposit) is debited at the time of reservation.
4. The tourist tax (taxe de séjour) is not included in the reservation price. Its amount is communicated at the time of reservation and is payable for all adult guests (except for individuals meeting the exemption conditions defined by the Cap Atlantique community of communes). It must be paid directly to the hotel at the time of billing.
5. In the event of a no-show (reservation not canceled – guest not present), the hotel will charge the client, as a flat-rate compensation, the total amount of the stay on the credit card provided as a reservation guarantee.
6. The credit card used for a prepayment or reservation may be requested by the reception upon arrival at the hotel.
7. The hotel accepts payment by bank card (Visa, Mastercard, and Amex), ANCV holiday vouchers, or cash, but does not accept checks.
Article 6: Relocation
1. In the event of Force Majeure, exceptional events, or technical problems in the hotel making the client’s stay impossible, the hotel will make every effort to find alternative accommodation, if possible in a hotel of the same category or a higher category. The costs of relocation (price supplement) will be borne by the hotel.
2. Hotel Casa Cosy cannot be held responsible toward the client for the non-execution of its obligations resulting from a Force Majeure event. Force majeure or fortuitous events are those usually recognized by the jurisprudence of French Courts and Tribunals.
Article 7: Stay at the Hotel
1. The hotel is accessible to any natural person. The number of people occupying the room cannot exceed that provided for the type of room concerned, including babies and children under 3 years old, and the number indicated on the reservation contract. The number of nights occupied cannot exceed that provided for in the contract. Management reserves the right to prohibit access to rooms to unregistered persons. Any additional night will be subject to a new reservation based on hotel availability.
2. In application of French regulations, the client will be asked upon arrival at the hotel to present an ID to verify their origin and that of those accompanying them. If the guest is of foreign origin, they must mandatorily complete a police registration form.
3. The client accepts and agrees to use the room in a reasonable manner and with due care. Therefore, any behavior contrary to good morals and public order will lead the hotelier to ask the client to leave the establishment without any indemnity or refund if a payment has already been made.
4. The client will be held responsible for any damage, degradation, or act of vandalism that may occur as a result of occupying the premises and/or due to the participants and/or staff they are responsible for, as well as damage resulting from the use of the Internet network such as data loss, viruses, or service interruption.
5. Keys and access codes are provided upon arrival at the establishment. In the event of a late arrival outside of reception opening hours, a dedicated procedure will be communicated to you to retrieve them.
6. Pets are not accepted within the establishment.
7. The hotel is entirely non-smoking. A smoking area is located in the hotel garden. In case of non-compliance, the hotel will charge the client a flat-rate cleaning fee of 70 euros on the credit card provided as a reservation guarantee.
8. Room Equipment: the layout, arrangement, and equipment of the room may under no circumstances be modified in any way. Furthermore, the resident is prohibited from moving any furniture and accessories belonging to the hotel or bringing additional equipment into the room.
After departure: Any item belonging to the Hotel and not returned will be subject to immediate billing at the hotel’s replacement rate.
9. Maintenance and repairs: cleaning is provided daily and after departure. If you wish for other arrangements, please let reception know. The resident is prohibited from carrying out repairs themselves in the room. In the event of stains on furniture, rugs, or carpets, they must contact the hotel reception.
10. Room Inspection: hotel staff may access the rented room to check the state of the premises, verify the proper functioning of installations, or carry out repairs, renovations, or transformations at any time.
11. Use of Common Areas: the resident shall not obstruct, temporarily or permanently, the common areas of the establishment with any object (bicycles, luggage, trash bags, etc.).
12. Insurance and Personal Belongings: The room and its furniture are insured against fire, water leaks, burglary, and glass breakage. Clients’ personal property and valuables are not covered by this insurance. The hotel specifically recommends that clients insure themselves and those traveling with them for all luggage, property, and valuables against loss or theft. Public liability insurance is also advised for everyone.
The client must inform the establishment of any degradation they caused. They are responsible for all damage caused through them and agree, in the event of degradation of the premises made available (room, common areas such as garden, lounge, bathrooms), to bear the restoration costs.
13. Forgotten Items: items left or abandoned may be sold under the conditions provided for by the law of March 31, 1896. If the client requests the return of their belongings by package or mail, this must be done with tracking and insurance for valuable items. The shipment will be made after the client pays the shipping costs.
Article 8: Governing Law and Disputes
1. Claims: any claim must be sent by registered mail with acknowledgment of receipt to Hôtel Casa Cosy – 2, Rue du Croisic – 44510 Le Pouliguen, at the latest 15 days after the departure date. After this period, no claim can be taken into account.
2. Mediator: In accordance with articles L.616-1 and R.616-1 of the Consumer Code, our company has set up a consumer mediation system. The selected mediation entity is: Médiation Tourisme et Voyage. In the event of a dispute, the consumer can file their claim on the website: www.mtv.travel

3. Applicable Law and Competent Jurisdiction: in the event of a dispute between the professional and the consumer, they shall endeavor to find an amicable solution. Failing an amicable agreement, French law shall be the only one applicable.
The cancellation of a clause of these general conditions will not affect these general conditions in their entirety. The order implies the full and unreserved adherence of the client to these general conditions, which prevail over all other conditions.
All disputes regarding the interpretation and execution of this contract shall be under the exclusive jurisdiction of the commercial court of Saint-Nazaire or the commercial court of the consumer’s domicile. In the event of a dispute, the French version of these terms and conditions shall prevail.
Article 9: Responsibilities
1. Even if every effort is made to ensure that the photographs, graphic representations, and texts reproduced to illustrate the hotel provide as accurate an overview as possible of the accommodation services offered, variations may occur, notably due to furniture changes or potential renovations. The client cannot claim any compensation for this fact.
2. Hotel Casa Cosy cannot be held responsible for the non-execution or poor execution of the reservation in the event of Force Majeure, the act of a third party, the act of the client, or the act of its partners, such as unavailability of the internet network, impossibility of accessing the website, external intrusion, computer viruses, or in the case of a prepayment not authorized by the cardholder’s bank.
3. Hotel Casa Cosy will not incur any liability for any indirect damage due to these presents, notably loss of business, acts of a third party, acts of the client, or acts of its partners.
4. The hotel declines all responsibility for noise and nuisances of any kind that are beyond its control or will or that are not located within the rented room.
5. Hypertext links mentioning the name Hotel Casa Cosy may refer to sites other than the site hotel.casacosy.fr, which declines all responsibility for the content of these sites and the services offered.
6. Any reservation or payment that is irregular, ineffective, incomplete, or fraudulent for a reason attributable to the client will result in the cancellation of the order at the client’s expense, without prejudice to any civil or criminal action against the latter.
7. Hotel Casa Cosy reserves the right, without notice or indemnity, to temporarily or permanently close the website hotel.casacosy.fr or the online reservation space.
8. Hotel Casa Cosy is not responsible for damages of any kind that may result from these changes and/or temporary unavailability or the permanent closure of all or part of the site or the services associated with it, such as the online reservation space.
Article 10: Evolution / Modification of General Terms and Conditions of Sale via the Internet
These General Terms and Conditions of Sale via the Internet may be modified and/or supplemented by Hotel Casa Cosy at any time. In this case, the new version of the General Terms and Conditions of Sale via the Internet will be posted online by Hotel Casa Cosy. As soon as it is posted online, the new version of the General Terms and Conditions of Sale via the Internet will automatically apply to all clients.
Article 11 – Telephone Solicitation
You have the possibility to register for free on the BLOCTEL telephone solicitation opposition list so as not to be solicited by telephone by a professional with whom you do not have an ongoing contractual relationship, in accordance with law n°2014-344 of March 17, 2014, relating to consumption.
